Board Meeting Minutes from 9 January 2023

(On-Site Meeting at 1601 High Hampton Ct)

Board Member Attendees: Tera Pauley (Vice President), Mike Pastor (Secretary), Dexter Blois (Treasurer), Heather Peery, Jeanne Yazinski, Matt Gillis.

Board Members Absent: Monica, Sandra {moved away}.

Resident Attendees: Susan Blois (present {her house}, not really participated-she lives here).

  1. This meeting was called to order by Tera, Vice President, at 7:02 PM.  This meeting was audio recorded by Mike to aid minutes preparation.
     
  2. Discussion was held regarding the now vacant President position (Sandra moved out of Tuscany).  It will be vacant until the Annual HOA Meeting board elections.  Jeanne is willing to become President after the annual meeting.
     
  3. The December Meeting Minutes of the H.O.A. Board were approved following a motion by Dexter, Jeanne seconded, followed by a unanimous vote.
  1. The Annual Meeting location (Cornerstone Community Church at 1333 E Crown Point Rd, Ocoee FL 34761) has been reserved for March 6th from 6:00-9:00 with the meeting to start at 7:00 PM.
  1. Treasurer’s Report
    1. Dexter mailed the December month-end / year-end the treasurer’s report as of December 31, 2022, to all homeowners with the Annual Dues Statement.
    2. Checking Account Balance was $8,071 (as of 12/31).
    3. Savings Account Balance was $43,532 (as of 12/31).
    4. We have not transferred any money from Savings to cover expenses that exceeded income since we still had not transferred excess revenue from 2021 to savings.
    5. As indicated, for several months, we have been over budget due to the extraordinary expenses for irrigation and the pond well and pump.
    6. A homeowner expressed appreciation that a special assessment was not needed since the H.O.A. Boards have done such a good job saving in past years and we were able to absorb and cover the unexpected major expenses this year.
    7. As a follow-up, a discussion was held regarding transferring some of the H.O.A.’s savings account into a one-year C.D. to earn about $1,395 interest with Fidelity or Schwab compared to $0.70 (70 cents) per month through our bank. 
    8. A homeowner raised the question “What would the HOA’s exposure be if a resident volunteer were to get injured while working on HOA property or caused damage to HOA property or equipment”.  
      1. Discussion ensued regarding the possible need for a worker’s compensation policy to cover volunteers in case of injury, however these are normally priced as a percentage of an organization’s payroll.  For us a non-payroll based policy, according to our insurance agent, would cost approximately $1,500 a year, or more. Additional research is needed.  Matt will determine how his church handles this for their volunteers. 
      2. As for damage to HOA property/equipment, our existing insurance would not cover it since it would be the association that would’ve caused the “theoretical damage” and we cannot insure ourselves against ourselves.  In the future, we need to be sure to hire insured contractors to perform such work.
    1. The Treasurer’s discussion ended without a motion to accept the December Treasurer’s Report, nor a second of the motion. It was not voted upon.  We will resolve this as a formality at the February Board Meeting.

Community Oversight Committee – Heather Peery

Yard of the month:

Votes were collected and tabulated through 12/17 for “best Holiday Decorated Residence” and announced the evening of December 17 at the Luminary evening reception.  The winner was 1600 Victoria Way Brent & Tera Pauley’s house.


ARB (Architectural Review Board) Requests Received & Approved:

Current Violations:

Q&A Discussion: Dexter asked about a permanent basketball hoop in the neighborhood.  Heather stated that was an ARB request years ago at 1567 from former owners (not current or previous owners, but before them) that had been approved by the ARB Committee at that time (1998 or earlier). 

Common Area:

The tab tree will be moved from right behind the leaning ligustrum which was trimmed to remove heavy limbs and it will be staked to aid it to grow straighter.

The tab tree will be relocated to the other side of the pond where a palm used to be that died and rotted out and removed. 

Sections of the hedge have died (along the fence line on Fullers Cross Rd East of the pond) and more are dying that will require attention this year.

OLD BUSINESS

County Grant (Add Aeration to Retention Pond)

The grant meeting will be at 2:30 on Wednesday, 01-11-23 to review the rules. This was previously scheduled for 1/01.  Dexter and Heather will attend.

  1. Tuscany street repaving is on the City of Winter Garden’s project list, but the specific dates are not yet known.

  NEW BUSINESS

  1. Annual Meeting preparation: Location reserved. Dexter ordered postage stamps to mail letters and notice of annual meeting date, time, location.  Tera will update the letter from last year for this year’s information. Jeanne will ask Sandra to email Tera last year’s letter.  Two current board member position vacancies (Sandra and Monica openings).  Dexter will print and mail the letters.

Next Board Meeting is scheduled on Monday, February 6, 2023, at 7:00 PM at Dexter’s house 1601 High Hampton Ct.

Annual Meeting: March 6, 2023, 7:00 PM at Cornerstone Community Church at 1333 E Crown Point Rd, Ocoee FL 34761.

Officer Election Meeting: March 13, 2023

Adjournment – Mike moved we adjourn. All Board Members seconded and approved it.  Tera adjourned the meeting at 7:42 PM.
