March Board Meeting 03-23-2015

Meeting was called to order 6:35 p.m. at the home of Sandra Wilt (1630 Victoria Way)

In Attendance Were: Sandra Wilt, Rick Uhlman, Lori Jones, Mike Pastor, Donna Horsley, Robert Walker, Dexter & Susan Blois, Jack Curall

Minutes of 3-01-2015 meeting were not yet unavailable

Treasurer's report presented and approved

  • Checking account balance $19,837.80
  • Savings account balance $43,410.47 (same as 2-28-2015)
  • Three homeowners have not yet paid 2015 dues. Each are being contacted

Landscape Report:

  • New flowers to be purchased/planted at front entrance
  • Lighting/electrical needs/assessment to be addressed next week

Old Business:

  1. CC&R (Covenants, Conditions & Restrictions) Update status report: It was agreed unanimously to have the attorney contacted to assist in developing 3 amendments (Sheds, Rentals, Recreational vehicles)
  2. Yard of the Month April nominees discussed
  3. Deed Restrictions prohibit rental houses:  Draft of rental prohibition amendment reviewed and approved unanimously with minor revisions. Amendment will be finalized along with Shed and Recreational Vehicle restrictions. Rental violation will be pursued via legal efforts.
  4. Front Entrance Wall:  Sandra met with Old World Masonry. Assessment: High quality bricks were used. Built incorrectly. Steel rusting causing mortar to pop out. Lack of expansion joints. May be able to wait 15 to 20 years before replacing. Liability concerns still exist. Repair costs $22,000 to $32,000 depending on which spans are repaired. Concerns expressed by attendees that we should not pay before work is completed. Sandra will explore pre-payment options.

New Business:

  1. Inquiries regarding stray cats in the neighborhood. Sandra contacted City of Winter Garden and Orange County Animal Services.
    1. County's responsibility  however they will not trap/remove stray cats
    2. Cats not required to have a tag (it's voluntary)
    3. If you trap a stray cat on your property, you can bring it to the Animal Control/Humane Society.
    4. You can call Orange County if a caught stray cat belongs to a neighbor.
  2. Neighborhood Picnic scheduled April 25th in the High Hampton cul-de-sac.
  3. Neighborhood Yard Sales on April 10. Signs need to be put up and announcement needs to be posted in Tuscany Facebook page.
  4. Jack reminded us that all meetings require 48 advance notice (front sign board), year-end account balances required to be reported, the Within 90 days board members must sign declaration they've read and will uphold CC&Rs, Bylaws, Articles of Incorporation and Rules/Polices, Surety Bond requirement as per Florida Statutes Chapter 720-Homeowners Associations
  5. Jack also expressed concerns that some CC&R violations are not enforced and that he is considering filing a lawsuit against HOA Board and its members individually for what he considers as dereliction of duty. Of course, this will cost all homeowners to respond/defend against such legal action.

Next Board Meeting:  Monday, April 20th at 6:30 PM at Sandra Wilt's home (1630 Victoria Way)  All homeowners are welcome to attend.
